There is no statutory requirement for OSCs to be consulted about proposals to change management arrangements unless (in this context) the proposals would result in service changes that require Monitor to alter an Foundation Trust's authorisation.

It is possible that the bids give an indication of the strategic direction proposed, possibly with indications of the kinds of service changes required to restore financial balance, and the OSC might be able to form a view about whether these changes would be 'substantial' enough to trigger a formal consultation.

Monitor has quite a narrow interpretation of the circumstances in which an amendment to authorisation is needed, so a conversation with Monitor might be helpful.
